We are excited that you are interested in our services. The protection of your privacy and personal data is very important to us. That is why the retrieval and usage of your data are always compliant with the terms of the General Data Protection Act (EU) 2016/679 (GDPR), the Federal Data Protection Act (BDSG), and the Teleservices Act (TMG). Below we, as the party responsible for data processing, inform you of which data we retrieve and how we process these data.
 

1. Personal Information

Personal data for purposes of GDPR are all information that refer to an identified or identifiable natural person; a natural person is identifiable if they can be directly or indirectly identified, especially through allocation of a characteristic such as a name, number, location data, online identifier, or one or more special markers that express the physical, physiological, genetic, mental, economic, cultural or social identity of this natural person. Personal information is only stored if such is required to render the ordered service, to adhere to legal regulations, or for the purpose specified below.
 

2. Anonymised Data / Logfiles

You may visit our website without the retrieval of personal data being required. However, during each visit to our website certain anonymised data are stored, e.g. which page or service was viewed. These data are not personally identifiable, however, and thus do not fall under the legal stipulations of GDPR or BDSG.

The website operator or page provider retrieves data concerning access to the page and saves them as "server logfiles". The following data are recorded in this manner:

Website visited, time at the point of access, quantity of data sent in bytes, source/reference from which you reached the page, browser used, operating system used, IP address used.

The data retrieved merely serve purposes of statistical evaluation and improvement of the website. However, the website operator reserves the right to belatedly assess the server logfiles if there are concrete indications of illegal usage.

Anonymous data are retrieved solely for statistical evaluation in order to improve our service. Please refer to the section "Right to Disclosure / Right to Revocation".
 

3. Purpose of the Retrieval of Personal Information

The retrieval of personal data is, however, imperative if you book a trip or other service through our portal, contact us, subscribe to our newsletter or would like to use other services of our page which require personal data in order to function. These also include coupon purchases and participation in contests.

In compliance with the legal regulations and in the interest of data economy, only those data required to render this very service are generally retrieved. If we ask for additional information in our forms, the provision thereof is always voluntary and is designated as such.

The temporary storage of your IP address by the system is required to facilitate provision of the website to the user's computer. To this end the user's IP address must remain stored for the duration of the session. Storage in logfiles also serves to ensure functionality of the website. The data also help us optimise the website and ensure the security of our information technology systems. There is no evaluation of the data for marketing purposes in this regard. These purposes also concern our justified interest in data processing as per Art. 6 para. 1 lit. f GDPR.

In the event that a trip or other service is booked, the data thereby retrieved will be used to render this reservation, for marketing purposes within the legal parameters, and for statistical purposes.

The legal basis for the sending of the newsletter following the sale of products or services is § 7 para. 3 UWG.

If you subscribe to our newsletter, we store and utilise the information about yourself and your trip, on the basis of Art. 6 para. 1 lit. f GDPR, so that we can provide you with optimal service as a newsletter subscriber.

The legal basis for the processing of the data after the user subscribes to the newsletter is, upon provision of consent, Art. 6 para. 1 lit. a GDPR.

We also use the personal information that we store to maintain customer relations, for customer care (e.g. information on the duration of your stay), to conduct our own marketing and advertising measures (e.g. sending catalogues and other marketing items within the legal parameters, feedback on customer satisfaction), and to render orders.
 

4. Legal Basis for the Processing of Personal Information

Provided we have obtained consent from the respective individual for the processing of personal information, the legal basis is Art. 6 para. 1 lit. a EU General Data Protection Act (GDPR).

Art. 6 para. 1 lit. b GDPR serves as the legal basis for the processing of personal information required to fulfil a contract in which the affected individual is a contract party. This also applies to processing required for the performance of pre-contractual measures.

In the event that the processing of personal information is required to fulfil a legal obligation to which our company is bound, Art. 6 para. 1 lit. c GDPR serves as the legal basis.

In the event that vital interests of the affected person or of another natural person necessitate the processing of personal information, the legal basis is Art. 6 para. 1 lit. d GDPR.

If the processing is required to protect a justified interest of our company or of a third party and the interests, basic rights and basic freedoms of the affected individual do not outweigh the former, the legal basis for the processing is Art. 6 para. 1 lit. f GDPR.
 

5. Forwarding Personal Information to Third Parties

Your personal information is forwarded solely within the bounds of the pertinent regulations, in particular those pertaining to data protection and antitrust.

If required for the rendering of the service that we contractually owe or legal obligations, your information will also be forwarded to subcontractors or service providers to render the service on our behalf or as ordered by us (e.g. technical execution of post and email delivery, payment processing, customer service).

Furthermore, the information is forwarded to persons or companies to complete your reservation, in particular airlines, trip organisers, hotels, travel agencies, car rental companies, ferry operators, authorities, etc. Note that the data protection regulations in these parties' base of operations may differ from those in Germany.

Your information is also disclosed and forwarded to third parties if we are obligated to by law or due to legally established, judicial proceedings.

You have the right to receive the information that you have provided to us in a structured, common and machine-readable format. You also have the right to provide this information to another responsible party with no interference by the responsible party to whom the personal information was already provided.
 

6. Storage and Deletion of Data

Your personal information will be stored within the bounds of the purposes specified under "Purpose of the Retrieval of Personal Information". The personal information of the affected person will be deleted or blocked once the purpose of storage is absent. Storage may also occur if such is permitted by European or national legislation in Union ordinances, laws or other regulations to which the responsible party is bound. Legislation has decreed numerous retention periods and obligations. The information is also blocked or deleted if a storage period stipulated by the aforementioned standards lapses, unless the information must be retained for formation or fulfilment of a contract.
 

7. Usage of Cookies

We use cookies (small computer files with text information that the web server sends to your internet browser) in order to improve your visit to our online presence. For example, some indications appear only once when you allow us to install a cookie. Our cookies also have an expiration date. Should you manually delete your cookies before expiration, you will receive a new one during your next visit to the page if you do not block the storage of cookies.

8. Usage of Google Maps

Our online presence uses Google Maps and the Google Maps API in order to visually display a map and geographical information. Through the usage of Google Maps, Google also retrieves, processes and utilises data about the usage of the Maps functions by the users of the webpages. At the data protection center there you can also change your settings so that you are able to manage and protect your data. 9. Facebook Social Plugins

This website uses Social Plugins ("plugins") of the social network facebook.com, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins are identified by one of the Facebook logos (white "f" on blue square or a "thumbs-up" icon), or are marked with the phrase "Facebook Social Plugin". Whenever a webpage of this internet presence that contains such a plugin is visited, the visiting browser forms a direct connection with the Facebook servers. The contents of the plugin are transmitted from Facebook directly to the respective browser, from where they are integrated into the website. 10. Facebook Conversion Pixel

This website uses the "Facebook Pixel" from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). This allows for users' behaviour to be traced after they have seen or clicked on a Facebook advertisement. This process serves to evaluate the effectiveness of the Facebook advertisements for statistical and market research purposes and may assist in the optimisation of future marketing measures.

The data retrieved are anonymous to us, and thus allow for now allocation to the users' identities. However, the data are stored and processed by Facebook so that allocation to the respective user profile is possible, and Facebook can use the data for its own marketing purposes in accordance with the Facebook data usage guidelines (www.facebook.com/about/privacy/). The user can allow Facebook as well as its partners to post advertisements both within and outside of Facebook. Furthermore, it may also store a cookie on the user's computer for these purposes. By visiting our website and our Facebook page you consent to this usage. In order to decline the general usage of cookies on your computer, the browser may be set so that no more cookies can be installed on the computer in the future and that previously installed cookies are deleted. Security also depends on your system. 12. Right to Disclosure / Right to Revocation; Other Rights of the Affected Party

You have the right:

  • as per Art. 15 GDPR to request disclosure of your personal information that we have processed. In particular you may request disclosure of the purposes of the processing; the category of personal information; the categories of recipients to whom your personal information was or will be disclosed; the planned duration period; the existence of a right to correction, deletion, limitation of processing or revocation; the existence of a right to complain; the origin of your data provided we did not retrieve them; and the existence of automated decision-making including profiling, as well as meaningful information on the characteristics thereof if applicable;
  • as per Art. 16 GDPR to immediately request the correction of incorrect information or completion of your personal information that we have stored;
  • as per Art. 17 GDPR to request the deletion of your personal information we have stored, provided the processing thereof is not required to exercise the right to free expression of opinion and information, to fulfil a legal obligation, for reasons of public interest, or to assert, exercise or defend legal claims;
  • as per Art. 18 GDPR to request the limitation of processing of your personal information provided you contest the accuracy of the data; the processing is illegal but you oppose to the deletion thereof and we no longer need the data, but you need them to assert, exercise or defend legal claims; or you have filed an objection to the processing as per Art. 21 GDPR;
  • as per Art. 20 GDPR to receive your personal information that you have provided to us in a structured, common and machine-readable format or to request conveyance thereof to another responsible party;
  • as per Art. 7 para. 3 GDPR to revoke your consent that you provided to us at any time. This will result in us no longer being able to process the data as per said consent; and
  • as per Art. 77 GDPR to file a complaint with a supervisory authority. Generally you can refer to the supervisory authority of your primary place of residence or workplace, or that of our company's location.
